Restructuring, redundancy and TUPE
Restructuring is something that you are likely to have to face at some point. You need someone who can understands the law and can answer your questions:
- When is a redundancy not a redundancy?
- When is there a job match or assimilation situation?
- How do I consult on redundancy and for how long?
- What are my redundancy pay liabilities?
- How much will redundancy pay cost me?
You may be dealing with the stress of TUPE transfers – sometimes bringing new staff in as a result of winning new service contracts, mergers and acquisitions; sometimes transferring out.
Either way, there is a minefield of complex legalities to be picked through in the redundancy and TUPE rules and regulations. Lawyers can give a really good top level view of where you stand. But the devil is in the detail and you need someone to do a great deal of detailed work in picking out what your redundancy and TUPE responsibilities and liabilities are in practice, and translating these in to action.
