TUPE and Culture Change

The Transfer of Undertaking (Protection of Employment) Regulations have complex and important impacts on employers’ obligations to employees whose contracts they take over.

TUPE provides pitfalls and hidden costs for the new employer.TUPE protects the employment terms and conditions of employees who are part of a ‘relevant transfer’ from one employer to another. This could be because:

  • A business moves from one company to another
  • A contract moves from one contractor to another
  • Work is outsourced, brought in house, or where companies merge


Our Managing TUPE training course is a practical and engaging one day programme that gives managers the knowledge and confidence to manage a TUPE transfer while equipping them with the skills to effectively maintain levels of motivation and engagement among the pre-existing workforce.

Learning objectives

By the end of the training course delegates will:

  • Understand when regulations apply, when people should be transferred and the provisions of a transfer
  • Be able to identify and assess areas of risk in relation to TUPE
  • Be able to identify the specific people management aspects related to TUPE transfers and the effect of transfers on particular contractual terms
  • Appreciate and be able to manage the challenges and risks while merging different organisation cultures
  • Be able to support pre-existing staff during the transfer in of a new workforce
  • Be able to support staff during their transfer out to another organisation
  • Understand the obligations around information provision and how to meet them
  • Understand the obligations around consultation and how to meet them
  • Be able to outline the implications of TUPE to affected employees
  • Recognise the need for clear and transparent communication in relation to TUPE
